Refund and Returns Policy

At Mannys Eyewear, we strive to provide the highest quality eyewear and ensure customer satisfaction. We understand that there may be instances when you may need to return or exchange a product. This Return Policy outlines the terms and conditions for returns and exchanges at our store. Please read this policy carefully when making a purchase.

Definition of Terms

Buyer– this is a Client(s) who intends to, or has entered into a contract for the sale of merchandise, or has purchased merchandise from Mannys Eyewear;

Contract for sale– This may be defined as the contract entered into at a particular time, between Mannys Eyewear and the buyer to purchase merchandise from Mannys Eyewear;

Merchandise– this shall be defined to include, spectacle frames, spectacle lenses, cleaning products, spectacle cases, and such other products as may be represented as being for sale by Manny’s eyewear at any particular time; and

Sale– where the merchandise is transferred from the seller to the buyer the contract is called a sale.

Eligibility

In accordance with Mannys Eyewear’s obligation to deliver the goods, the buyer shall be eligible to return any defective goods, or goods that may have been damaged in transitu provided that there is full compliance with this return policy.

Subject to the buyer’s responsibility to accept and pay for the merchandise, the buyer shall be eligible to return any merchandise by Mannys Eyewear in so far as they had paid for the merchandise in full and taken into possession the said merchandise, communicated or reserved proof of the taking into possession of the merchandise.

Where the buyer enters into a contract for sale with Mannys Eyewear for the sale of goods by description, there is an implied condition that the goods shall correspond with the description devoid of which, the buyer shall be eligible to return the merchandise that is not compliant with the descriptions that were issued. However, the buyer shall not be eligible to return goods that were delivered having perfectly met the description set out by the seller pursuant to the contract for sale whether express or implied.

Where goods are delivered to the buyer that the buyer has not previously examined, the buyer is not deemed to have accepted them unless and until he has had a reasonable opportunity of examining them for the purpose of ascertaining whether they are in conformity with the contract and should they not conform with the contract, the buyer is eligible to return them to Mannys Eyewear.

Where the buyer has accepted the goods or part thereof, or where the contract is for specific goods the property in which has passed to the buyer, the breach of any conditions to be fulfilled by Mannys Eyewear can only be treated as a breach of warranty and not as a ground for rejecting the goods, treating the contract as repudiated and returning the goods.

A third party shall not be eligible to return the merchandise, where the merchandise by Mannys Eyewear was sold by a person (the seller) and not Mannys Eyewear thereof.

Where Mannys Eyewear delivers to the buyer a quantity of goods less than that in the contract for sale, the buyer may return them, but if the buyer accepts the goods so delivered he must pay for them at the contract rate agreed upon with Mannys Eyewear at the time of entering into the contract for sale.

Where Mannys Eyewear delivers to the buyer a quantity of goods larger than he contracted to sell, the buyer may accept the goods included in the contract and return the rest, or he may return the whole; and if the buyer accepts the whole of the goods so delivered he must pay Mannys Eyewear at the contract rate according to the contract for sale.

Mannys Eyewear reserves the right to reject a return in the event that, in Mannys Eyewear’s professional opinion, the patent defect may be remedied or fixed.

Timeframe

Merchandise shall be deemed to be in the course of transit from the time when they are delivered to a carrier by land, air or water, or other Bailee or custodier for the purpose of transmission to the buyer, until the buyer or his agent in that behalf takes delivery of them from the carrier.

The timeframe within which merchandise may be returned shall be within a minimum of three working days.

Proof of Purchase

The buyer shall be required to demonstrate proof of purchase of the specific merchandise in such a manner that shall be sufficient enough to identify the merchandise, to demonstrate the mode of payment, the means of payment and the buyer.

Failure to demonstrate proof of purchase shall render the return nugatory and Mannys Eyewear shall not be liable in any action advanced by the buyer against Mannys Eyewear.

Delivery by Carrier

Where, in pursuance of a contract of sale, Mannys Eyewear is authorized or required to send the goods to the buyer, delivery of the goods to the carrier, whether named by the buyer or not, for the purpose of transmission to the buyer, is prima facie deemed to be a delivery of the goods to the buyer and the buyer covenants that there is no liability and there can be no return on the part of Mannys Eyewear. For carriers recommended and authorized by the buyer, Mannys Eyewear is not obliged to make such a contract with the carrier on behalf of the buyer as may be reasonable having regard to the nature of the merchandise and the other exigent circumstances outside the handling of the merchandise; and if the buyer omits so to do, and the goods are lost or damaged in course of transit, the buyer shall treat the delivery to the carrier as a delivery to himself and shall not be eligible for a return of the damaged goods.

Condition of the Returned Merchandise

For merchandise whereby there was a sale by description, the returned merchandise should be returned in such a condition that they are unused, not damaged, and not altered in any way. The merchandise should be in such a way as was packaged prior to the occasioned damage and all the accessories that accompanied the damaged merchandise as in the contract for sale and at the time of the delivery. Failure to abide by the pro the buyer consequently relinquishes their right to return the merchandise, absolves Mannys Eyewear of any liability and forfeits any legal claim arising or incidental as and against Mannys Eyewear.

For merchandise within which there was damage, a description to include the events leading to the damage, the person in possession at the time of the damage, and the extent of the said damage should be made by the buyer addressed to Mannys Eyewear and it should include the merchandise as was packaged prior to the occasioned damage and all the accessories that accompanied the damaged merchandise as was in the contract for sale and at the time of the delivery.

Return Method

Customers can choose one of the following methods to return items: In- store returns or shipment by carriers. If the buyer chooses In-store returns, the buyer may visit Mannys Eyewear with the product and proof of purchase for a return.

Should the buyer choose shipment by carriers, they ought to contact our customer service team to initiate the return process and obtain return shipping instructions.

In the event that a carrier is preferred, Mannys Eyewear is not liable for any damages or losses occasioned by the same and Mannys Eyewear will not accept any merchandise that has been altered, exacerbated, or lost

For merchandise that has been damaged, it should be returned in such a manner that does not aggravate the extent of the damage and in a manner that preserves the integrity of the merchandise or the parts which are not damaged.

When returning merchandise that is not in conformity with the description given when entering into the contract for sale, the merchandise should be repackaged as was packaged prior to the delivery and should include all the accessories that accompanied the damaged merchandise as was in the contract for sale and at the time of the delivery.

Refund and Exchange Options

Mannys Eyewear reserves the full discretion to refund the buyer for any returned merchandise subject to a conclusive investigation of the merchandise and this does not amount to an existing claim for a refund.

Mannys Eyewear reserves the full discretion to offer to exchange merchandise for similarly priced merchandise or request an extra amount to offer a different product subject to the consent of the buyer.

Mannys Eyewear reserves the right to refuse an offer to issue a partial refund accompanied by cheaper merchandise to the buyer as a form of a refund or exchange option.

Restocking Fees

For any merchandise returned in its original sale condition, devoid of damage, alteration, or defects the merchandise shall be deducted a 25% (read Twenty-Five percent) restocking fee.

Exceptions for merchandise that may be returned

Mannys Eyewear shall not accept the return of customized merchandise that has not been damaged or is not defective. Mannys Eyewear shall not allow the return of cleaning products for spectacles and cleaning fabric for spectacles. Prescription lenses and custom-made eyewear are not eligible for returns or exchanges unless they are defective. Mannys Eyewear shall not allow the return of Gift cards.

Damaged or Defective Products

In the event of damaged or defective products, the buyer should provide a description to include the events leading to the damage, the person in possession at the time of the damage, and the extent of the said damage or defect should be made by the buyer and addressed to Mannys Eyewear and it should include the merchandise as was packaged prior to the occasioned damage and all the accessories that accompanied the damaged merchandise as was in the contract for sale and at the time of the delivery.

Customer Responsibilities.

A buyer is bound to notify Mannys Eyewear within the specified timeframe of any intended returns of the merchandise.

The buyer in their communication should clearly set out the details leading to any damage or any existing defect in the merchandise and they should be truthful and act in the utmost good faith when providing this information. In the event that these disclosures are not made or deemed to be made in bad faith, Mannys Eyewear may reserve the right to reject any returns.

The buyer has a responsibility to properly package any returned merchandise as set out in this return policy.

Conditions and Warranties

The return policy may be construed in a way that promotes the interest and accords the benefit of the doubt to Mannys eyewear.

This return policy shall apply independent of the contract of the sale of the merchandise by Mannys Eyewear save for instances whereby it is expressly provided and or referenced under this return policy that the provisions under the agreement of sale shall apply.

A stipulation may be a condition though, though called or represented as a warranty in the contract for the sale of merchandise by Mannys eyewear.

Stipulations as to the time of payment and the time period of return are deemed to be of the essence in a contract for the sale of merchandise by Mannys Eyewear.

It shall be inferred that a buyer has chosen to abide by this return policy when the buyer agrees to the agreement for sale. The buyer is obliged to abide by this return policy should they choose to accept this terms and conditions on prompt.

Dispute Resolution

At the discretion of the Mannys eyewear management, a complimentary package may be issued in the event of a returned product damaged in transitu. This does not qualify as an admission of guilt, or liability and the customer covenants not to use the same against Mannys eyewear.

In the first instance, all disputes shall be resolved through negotiation and or mediation before any party can begin exploring any other legal remedies.

Amendments to the Return Policy

Mannys Eyewear exclusively reserves the right to modify or update the return policy at any time.

The communication on the effected changes shall be done through Mannys Eyewear official website. This shall suffice as official and clear communication on any changes to the customers and buyers.

Interpretation of this Policy

This policy shall be interpreted purposively and in a manner that promotes profit, the benefit of doubt to Mannys Eyewear and the best industrial business practices.

Severability

Each proviso in this return policy is distinct and severable in so far as no relationship between such has been expressed with the utmost clarity by this policy.

Governing Law

This policy shall be governed by the Laws of Kenya.
