Welcome to Mannys Eyewear (hereinafter referred to as ‘we’, ‘our’, the ‘Company’), a modern, design-driven eyewear company and your (the ‘Client’) premier destination for high-quality optical frames, lenses, and related services. These terms and conditions govern your use of our website and services. 

By accessing or using our website and services, you agree to be bound by these terms and conditions, any policies thereto and where applicable any regulations governing the Company.

By placing an order or using our services, you acknowledge that you have read, understood, and agree to these terms and conditions. If you do not agree with any part of these terms, you may opt out of any services, messaging and you may not access our website or use our services.

Any documents referenced in these terms and conditions are available on request and the failure to request the same on your part does not negate any agreement to these terms and conditions.

Orders and Purchases

You may place orders for our products and services through our website by contacting our customer service team or by visiting our offices in the address listed on our official website.

All prices that are listed on our website are in Kenyan Shilling (KES) and are subject to applicable taxes and fees. Any incidental price alterations e.g. discounts may be communicated on a case-by- case basis and shall be effective for the period that may be prescribed by the Company or where any prescription isn’t readily available, on such notice as may be given.

In line with this provision, Notice shall mean any verbal or official written communication by the Company.

We accept payments via credit card, mobile money, or cash payments. These methods may be indicated on our website.

Shipping and Delivery

We offer shipping within Kenya and internationally, with delivery times varying depending on location and shipping method. While we make every effort to meet estimated delivery times, we cannot guarantee delivery by a specific date and are not liable for delays beyond our control. 

The delivery costs shall vary depending on location, method of delivery and previous agreements with Clients. These costs may be transferred on to the Client by the Company where appropriate and the same shall be communicated to the Client promptly. Failure to pay the transferred costs shall not give rise to liability on our part.

Returns and Exchanges

We accept returns of unused and undamaged products within such a period as may be set out, subject to our return policy. The acceptance of the returns shall be solely upon the discretion of the Company and shall be exercised in accordance with the Company’s return policy. The Return policy may be amended from time to time and it is the Client’s obligation to ensure that they are up to date with the latest amendment.

Exchanges for defective or damaged products are available within such a period as may be set out in the return policy, subject to availability. Any refunds thereof shall be made in accordance with the return policy and shall also be based on the Company’s discretion.

Product Warranty

Our products are covered by a limited warranty against manufacturing defects for a period of three months from the date of purchase.

To make a warranty claim, please contact our customer service team with proof of purchase and a description of the manufacturer’s defect.

Intellectual Property

All intellectual property rights related to our products and services, including trademarks and copyrights, are owned by Mannys Eyewear Limited.

You may not use our trademarks, logos, or other proprietary materials without prior written consent.

Privacy Policy

We collect and use personal information in accordance with our privacy policy, which can be found on our website.

By providing your contact information, you consent to receive marketing communications from us. You may opt out at any time.

Liability and Disclaimers

We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our products or services.

We make no warranties, express or implied, regarding the suitability or fitness for a particular purpose of our products or services.

Governing Law

These terms and conditions shall be governed by the Company’s Articles of Association, any other policies thereto and generally by the laws of Kenya.

Dispute Resolution

Any disputes arising out of or relating to these terms and conditions shall first be referred to negotiation between the conflicting parties and where negotiation shall not be successful, the dispute shall be referred to mediation with an impartial mediator agreed upon by both parties and at the expense of both parties.

Should there be a failure to reach a consensus the aggrieved party shall be at liberty to institute the said claim in a Kenyan Court of law in accordance with the Laws of Kenya.

General Provisions

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These terms and conditions constitute the entire agreement between you, the Client and Mannys Eyewear regarding your use of our website and services.
